OFT Varies Reference
Following the Office of Fair Trading’s
(OFT) reference to the Competition Commission (CC) for an investigation
into the supply of domestic bulk lpg, the OFT received a number
of representations from companies within the industry taking
issue with the OFT’s definition of ‘domestic’.
The
OFT takes ‘domestic’ as meaning ‘supplied
for use by households, as well as for use by businesses whose
consumption of lpg by volume is similar to that of households’.
The companies pointed out that this definition was broader than
was set out in the OFT’s earlier document.
Having consulted
with the CC and businesses operating in the industry, the OFT
has stated that it is satisfied that it is
appropriate to vary the reference under the Enterprise Act 2002.
In paragraph 1 of the reference, the words ‘domestic bulk
lpg’ will be replaced with ‘bulk lpg for domestic
use’, and in paragraph 3, the bullet point defining ‘domestic’ is
omitted.
